The fight between bottled water major Bisleri and Mt Everest over the usage of Himalayan brand reached a new pitch Tuesday with Ramesh Chauhan-promoted firm accusing the Tata group company of fabricating and pasting label on its bottles.
"We were surprised about how the bottle went out of our shelf as it had not been marketed. We got the bottle inspected by our company's lawyers and technical personnel who found that there was overpasting on an existing label," Chauhan told PTI.
Bisleri and Mt Everest have been fighting a case at the Delhi High Court over prominent usage of the world 'Himalayas' by the former.
Mt Everest, however, said it was Bisleri who had done pasted the label over its own bottles.
It was pointed out by Tatas to the Delhi Court during the last hearing on June 24 that the contentious label was pasted over another by Bisleri itself under the instructions of lawyers.
"The learned counsel for the defendants (Bisleri) stated that they had advised their clients to paste the label over another label," Mt Everest said in an affidavit to be filed before the court.
Mt Everest also pointed out that in its application filed before the court for joint inspection and recording of bottles over the contentious labels, Bisleri had admitted it had made a previous attempt to do so without informing it.
On Monday the court had allowed both parties to inspect the bottles and take photographs of bottles with both normal and disputed labels.
