The controversy relating to cash-at-door scam involving two judges of the Punjab and Haryana High Court is turning ugly.
In a reply to the Chief Justice of India, Justice Nirmal Yadav of Punjab and Haryana High Court has leveled serious allegations on a sitting Supreme Court judge to protect Justice Nirmal Jit Kaur.
News X has got the copy of the reply letter written by Justice Nirmal Yadav to the Chief Justice.
In August, 2008 Rs 15 lakh were delivered at the door of Justice Nirmal Jit Kaur.
Justice Gokhle Committee appointed by the Chief Justice of India had given a finding that the money was meant for Justice Nirmal Yadav. But Justice Yadav said that she was made the scapegoat in the entire matter because her name is similar to Justice Nirmal Jit Kaur.
In her reply, Justice Yadav has said that she has been harassed unnecessarily.
“… I am shocked at the lopsided enquiry conducted by the committee. The committee assumes that it was solely asked to enquire against me whereas I feel that the enquiry ought to have been for determining the truth with regard to the incident of delivery of money at the residence of Ms. Justice Nirmal Jit Kaur on 13.08.2008. The committee itself records that a judge of the Supreme Court and a senior judge of the High Court may have been present in the house at the time of delivery of cash….” She wrote in the letter.
Justice Yadav has also questioned the role played by her sister judge Justice Nirmal Jit Kaur. According to Justice Yadav, “… The call records also establish the presence of the judge of High Court at the residence of Ms. Justice Nirmaljit Kaur at the time when the cash was delivered. The call records of the Supreme Court judge’s son reveal that his son was in constant touch with Mr Sanjeev Bansal who sent the cash. In spite of clinching evidence which establishes the falsity of the statement of Justice Nirmal Jit Kaur with respect to absence of these judges at her residence at the time of receipt of cash….”
The matter is now pending with the Chief Justice of India Justice K G Balakrishnan. The Chief Justice had earlier given the permission to the CBI to question both the judges.
