Delhi High Court upholds Agnipath scheme

A bench consisting of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad denied petitions for reinstatement and enrollment under the earlier recruiting process.

The Delhi High Court affirmed the constitutionality of the Agnipath short-term military recruiting plan on Monday, saying it was created in the national interest and to properly equip the armed services. Court dismissed appeals against the plan, which sparked demonstrations last year due to its shorter term and lower rewards.

A bench of chief judge Satish Chandra Sharma and justice Subramonium Prasad also dismissed petitions seeking reinstatement and enrolment in the former recruiting programme in the defence services, ruling that the petitioners lacked the legal power to do so. “This court sees no basis to intervene in the programme. All applications against the Agnipath programme have been rejected “According to the court.

A complete decision will be made available later in the day.

On December 15, the bench deferred its decision and requested the parties to present written arguments by December 23, before the court’s winter break.
