Gujarat HC stays proceedings against Delhi LG VK Saxena in 2002 assault case

The Gujarat High Court on Tuesday stayed the proceedings against Delhi Lieutenant Governor VK Saxena in a 2002 assault case. The court issued the stay order on a petition filed by Saxena, who challenged the trial court’s order summoning him as an accused in the case.

The case relates to an incident that took place in 2002 when Saxena was the Commissioner of Police in Ahmedabad. He is accused of assaulting a man named Raju Solanki during a protest against the Gujarat government.

Solanki had filed a complaint against Saxena in 2002, but the case was not pursued by the police. In 2017, the Gujarat government decided to reopen the case and Saxena was summoned as an accused.

Saxena challenged the trial court’s order in the Gujarat High Court. In his petition, he argued that the case against him was politically motivated and that there was no evidence to support the allegations.

The Gujarat High Court agreed with Saxena’s arguments and stayed the proceedings against him. The court also directed the trial court to dispose of the case within six months.

This is a significant victory for Saxena, who has been facing the threat of prosecution for several years. The stay order by the Gujarat High Court will allow him to focus on his duties as the Delhi Lieutenant Governor without the distraction of a criminal case.

The case against Saxena is a reminder of the violence that took place in Gujarat in 2002. The riots, which were sparked by the Godhra train burning, resulted in the deaths of over 1,000 people, mostly Muslims. Saxena was one of the senior police officers who were responsible for maintaining law and order during the riots.

The allegations against Saxena have been denied by him and his supporters. They have accused the Gujarat government of reopening the case for political reasons. The Gujarat government has denied these allegations.

The stay order by the Gujarat High Court is a setback for the Gujarat government. It will now have to prove its case against Saxena in court. The case is likely to drag on for several years and could have a significant impact on Saxena’s career.
