SC to Consider Plea for Moving Sandeshkhali Case

The Supreme Court is scheduled to hear a plea tomorrow seeking the transfer of investigation and subsequent trial outside West Bengal concerning the alleged sexual assault on women in Sandeshkhali village.

Advocate Alakh Alok Srivastava has filed the plea, urging the Supreme Court to transfer the investigation and trial outside West Bengal due to concerns about impartiality. The plea also requests either a Central Bureau of Investigation (CBI) or a Special Investigation Team (SIT) probe monitored by the Supreme Court.

Expressing deep concern over the incident, Srivastava highlights the absence of action by local authorities, particularly the failure to arrest the main accused, Sheikh Shahjahan. Allegations of collusion between local police and the accused further emphasize the need for an impartial investigation.

In the Public Interest Litigation (PIL), Srivastava proposes the formation of a committee comprising three retired high court judges, similar to the one established in the Manipur atrocity case. Additionally, he urges the court to ensure compensation for the victims under relevant schemes and deploy central paramilitary forces for their protection.

Furthermore, Srivastava seeks to expedite the trial by conducting it in a Fast Track Court in Delhi upon completion of the investigation. He also calls for disciplinary and penal action against negligent policemen in West Bengal.

The plea underscores the importance of justice and fairness in handling such sensitive cases, emphasizing the need for impartial investigation and trial proceedings.
