In the latest development, Aam Aadmi Party (AAP) MP Sanjay Singh has been granted bail by the Supreme Court of India today on (April 2). He is released after spending about six months in Tihar jail over the Delhi Excise policy case.

Why Was Sanjay Singh Arrested? 

To have a grasp of history in political chaos, Sanjay Singh was apprehended by the ED on October 4, 2023, subsequent to searches conducted at his residence in Delhi.

Allegedly, an employee of businessman Dinesh Arora delivered Rs. 2 crores to Singh’s house on two occasions, as asserted by the central agency. Arora, who later became an approver in both ED and CBI cases, initially accused Singh, leading to his arrest.

Despite Singh’s petitions challenging his arrest and seeking bail being rejected by the Delhi High Court, the Supreme Court is now considering two special leave petitions filed by him – one contesting his arrest and the other seeking bail.

During the recent hearing, Singhvi, representing Singh, highlighted that the ED’s case against Singh primarily relies on the statement of Arora, who initially made several exculpatory statements before naming Singh.

Singhvi alleged that the ED’s actions were retaliatory, particularly after Singh held a press conference. He further criticized the ED for using unrelied documents containing exculpatory statements by Arora. Singhvi urged the court to intervene, labeling this practice as unjust.

Singhvi also questioned the necessity of Singh’s arrest and criticized the ED’s efforts to secure bail for Arora without explicitly stating so. Additionally, there was discussion during the hearing about whether the alleged bribe amount of Rs. 2 crores constitutes a predicate offense under the PMLA and whether the PMLA would be applicable in cases of bribery. Singhvi emphasized that the offense under the PMLA relies on the existence of proceeds of crime, which, if not established, renders the invocation of PMLA invalid.
