Public Internet Litigation (PIL) has been moved in the Delhi High Court, in order to disqualify Aam Aadmi Party’s (AAP) Satyendar Jain for being the Member of the Legislative Assembly and apparently the Minister in Government of NCT of Delhi.
According to the plea, Satyendar Jain, a cabinet minister in the Delhi Government and Member of the Legislative Assembly from the Shakur Basti Assembly constituency, declared that he lost his memory before the Enforcement Directorate (ED) and the same has also been told to the trial court by the Additional Solicitor General.
The complaint stated that the Delhi Government is clearly violating the Provisions of the Constitution of India under Article 191 (1)(b) which clearly states ‘a Person shall be disqualified for being chosen as, and for being, a member of the Legislative Assembly or Legislative Council of State if he is of unsound mind and stands so declared by a competent court’.
Through his advocate Rudra Vikram Singh, the petitioner Ashish Kumar Srivastava asked the Delhi government to direct them to declare all of his decisions to be invalid after developing Covid and losing his memory.
The petitioner also asked for directions to the Centre to form a medical board to examine Satyendar Jain’s mental state.
The petition furthur said that Satyender Jain is in charge of many significant portfolios for the government of the NCT of Delhi. Every day he must make numerous decisions and sign lots of documents and orders. However, since he admitted to having memory loss, anyone can exploit this condition to their advantage, ultimately hurting Delhi’s voters.
Division Bench headed by the Chief Justice of Delhi will hear the matter on August 16 2022.
