Uttarakhand Cabinet Passes Stringent Law to Compensate Losses in Riots; Await Governor’s Approval

Uttarakhand Chief Minister Pushkar Singh Dhami’s government has taken a bold step in combating rioting incidents by approving what is being termed the country’s most stringent law to provide compensation for losses incurred during riots. In a recent Cabinet meeting, the decision was made to introduce the Uttarakhand Public and Private Property Recovery Ordinance 2024, aiming to clamp down on riotous behavior and ensure accountability for damages.

Under the provisions of this ordinance, a special tribunal will be established to handle cases related to riots and unrest. Chief Minister Dhami emphasized that those responsible for disturbing the peace of the state would face severe consequences, setting a precedent for future generations of rioters.

The law mandates that perpetrators of rioting incidents will be held liable for the entire damage caused to both public and private property. This includes compensating for the expenses incurred by government staff and other agencies involved in riot control. Additionally, rioters could face hefty fines of up to Rs 8 lakh.

The legislation also encompasses provisions for the establishment of a formal Claims Tribunal to ensure swift and stringent action against rioters. If found guilty, rioters and their families may face property seizure to cover the costs of damages. An Additional District Magistrate (ADM) has been appointed as the Claims Commissioner to oversee the tribunal’s proceedings.

Following its approval by the Cabinet, the ordinance has been sent to the Governor for final approval. Given the urgency of the matter and the absence of the State Legislature, the Governor holds the authority to implement the law under Article 213 of the Indian Constitution.

Once ratified, the Uttarakhand Public and Private Property Recovery Ordinance 2024 will come into effect, marking a significant step towards deterring riotous behavior and ensuring swift justice for victims of such incidents.

In addition to addressing law and order issues, Chief Minister Dhami also focused on administrative matters by distributing appointment letters to Assistant Accountants and Gram Panchayat Development Officers. This ceremony, organized by the Panchayati Raj department, highlighted the government’s commitment to efficient governance and public service.

The proactive measures taken by the Uttarakhand government underscore its dedication to maintaining peace and security within the state, while also prioritizing the welfare of its citizens.
